Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of certiorari calling for the records relating to the impugned notice dated 27.09.2023 issued by the second respondent to the second petitioner (for and on behalf of all residents of Adayalampattu), quash the same.

ORDER

(Order of the court was made by the Hon'ble Chief Justice) Heard Mr.R.Singaravelan, learned Senior Counsel for Mr.P.Sathish, learned counsel for the petitioners and Mr.P.Muthukumar, learned State Government Pleader, assisted by Mrs.R.Anitha, learned Special Government Pleader for the first respondent.

2. Learned State Government Pleader, on instruction, submits that the impugned notice would stand withdrawn and the Block Development Officer would take fresh action under Section 131 of the Tamil Nadu Panchayats Act, 1994.

3. In view of the fact that the impugned notice is sought to be withdrawn, no further orders are required to be passed in this writ petition.

4. The writ petition, accordingly, is disposed of. There will be no order as to costs. Consequently, W.M.P.No.29749 of 2023 is closed. W.M.P.No.29748 of 2023 filed to permit the petitioners to file a single writ petition stands allowed, inasmuch as the petitioners have paid separate court fee.
