ORDER
The relief sought for in this writ petition is to direct the respondents 1 and 2 to conduct survey and to demarcate boundaries in respect of the property comprised in Survey Nos.649/5 to an extent of 19.5 Ares (48.165) Cents, situate at Puthur Village, Sirkazhi Taluk, Mayiladuthurai District based on the petitioner's representation dated 22.10.2024 and payment receipt dated 22.10.2024.
2. Mr.R.P.Murugan Raja, learned Government Advocate takes notice on behalf of the respondents 1 & 2. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.
3. The case of the petitioner is that the petitioner is the absolute owner of the property comprised in S.Nos.649/5 to an extent of 19.50 Ares (48.165) cents situate at Puthur Village, Sirkazhi Taluk, Mayiladuthurai District. This being so, the neighbouring land owners are 2/6
trying to grab the petitioner's property. Therefore, he made an online application dated 29.09.2023 along with relevant documents and requisite fee to survey the land and to demarcate boundaries and also gave a representation in person on the same day. However, the same was not considered. Therefore, the petitioner has made another online application dated 22.10.2024 for the similar relief, along with requisite fee. He has also made another representation to the first respondent in person, on the same day i.e., 22.10.2024, which was also not considered by the respondents, as on date. Hence, the petitioner has come forward with the present writ petition.
4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the respondents 1 & 2 to consider the petitioner's representation dated 22.10.2024 to survey the property and demarcate the boundaries.
5. Learned Government Advocate appearing for the respondents submitted that the representation of the petitioner dated 22.10.2024 3/6
would be considered and orders passed within a time frame that may be fixed by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.
7. Considering the limited relief sought for by the learned counsel for the petitioner, this Court directs the respondents to conduct a survey and fix the boundaries in respect of aforesaid petitioner's property, after giving due notice and opportunity of personal hearing to the petitioner as well as aggrieved persons, if any, within a period of two weeks from the date of receipt of a copy of this order. It is needless to say, in case of any obstruction being created by third parties, the second respondent is at liberty to approach the Police officials, in which case, the Police officials shall render assistance to the second respondent to carry out the aforesaid exercise.
8. With the aforesaid direction, this writ petition is disposed of. No costs.
