Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondent to pay the Petitioner the amount payable towards the encashment of 45 days of earned leave, surrendered by him in the years before his retirement and to pay him a sum of Rs.18,500/- towards the STERBS (State Transport Employees Retirement Benefit Scheme), which was deducted from his Salary for every month, while he was in service, together with interest at the rate of 12 % p.a., within a specified time. 1/6

The Writ Petition is filed for the following relief: "directing the respondent to pay the Petitioner the amount payable towards the encashment of 45 days of earned leave, surrendered by him in the years before his retirement and to pay him a sum of Rs.18,500/- towards the STERBS (State Transport Employees Retirement Benefit Scheme), which was deducted from his Salary for every month, while he was in service, together with interest at the rate of 12 % p.a., within a specified time".

2. The petitioner joined the service of the respondent corporation on 14.12.1986. After rendering 32 years of service, the petitioner retired from the service on 31.08.2018. The petitioner would submit 2/6

that the respondent failed to settle the amounts due towards earned leave. The petitioner would further submit that he is entitled to a sum of Rs.18,500/- under STERBS (State Transport Employees Retirement Benefit Scheme) and the same has not been paid to the petitioner. In this regard the petitioner sent a representation on 27.12.2024 to the respondent. However, there is no response. Therefore, the petitioner is before this Court.

3. Heard the learned counsels and perused the records.

Considering the facts and circumstances of the case and in the light of the fact that the respondent has acknowledged the due amounts to the petitioner vide RTI reply, the respondent is directed to disburse the due amounts within a period of 1 month from the date of receipt of a copy of this order.

5. The Writ Petition is allowed with the above observation. No costs.
