PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying for a writ of Mandamus, directing the first respondent to consider the petitioner's son Sanjeet Krishna K Under MBC quota in the third counseling of NEET Based UG Medical Courses (MBBS) proposed to be held shortly by the first respondent.

The writ petition is filed seeking a direction to the 1st respondent to consider the petitioner under MBC quota in the third counselling of NEET based UG Medical Courses (MBBS) proposed to be held shortly by the 1st respondent.
2. The contention of the writ petitioner is that on 02.08.2024 she made an application for NEET based UG Medical Courses (MBBS) on the strength of the certificate dated 28.05.2024. On 02.09.2024, the petitioner had filed an application to the Tahsildar, Oulgret requesting Page No.2/6
him to give an MBC certificate. The MBC certificate was issued to the petitioner on 20.09.2024. By then, the first counselling was over and the next counselling was held on 27.09.2024. The contention of the petitioner is that the petitioner was considered only under the general category and the petitioner was not considered under the MBC category.
3. To ascertain the same, the learned Government Pleader (Pondicherry) was directed to get instructions. The learned Government Pleader (Pondicherry) submits that there is no vacancy as on date available under the general, EWS, OBC, MBC, EBC, BCM, SC and BT categories. In view of the same, the question of accommodating the petitioner may not arise.
4. However, the learned counsel for the petitioner would submit that on 24.10.2024, the next counselling is likely to take place. If there is any vacancy, the petitioner may be considered in the same.
5. It is the contention of the learned Government Pleader (Pondicherry) that the request of the writ petitioner was already rejected Page No.3/6
and the same was not challenged.

However, keeping all these facts aside the primary contention and the intention of the writ petitioner is only to avail accommodation in the UG Medical Courses (MBBS) if there is any vacancy and it is not on any other technicalities. In the event of any vacancy that may arise in the counselling which is likely to take place on 24.10.2024, not only the petitioner, the persons who are similarly placed like the petitioner may also be considered.
