ORDER

This Writ Petition is filed seeking a Writ of Mandamus directing the 1st respondent to consider the petitioner's application dated 02.09.2022 and further direct him to issue Patta in favour of the petitioner in respect of his property comprised in Survey No.124, bearing Door No.2, Kannabiran Koil Street, Eerukkancherry, Chennai - 600 118.

The contention of the petitioner is that he purchased the schedule mentioned property on 26.03.2007 from one Nirmala and the Sale Deed is registered as Document No.3031/2007 on the file of the SRO, Sembium, and that he has been residing in the said property along with his family from the date of purchase without any interference. The petitioner effected mutation of name transfer in all the revenue records and also paying the property tax and other taxes. While so, the petitioner made a representation dated 02.09.2022 requesting to issue Patta for the above said property in the name of the petitioner. But neither reply was given nor Patta was issued. Hence, the petitioner has filed the present writ petition seeking a direction to the 1st respondent to consider the petitioner's representation. 2/5

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

In the light of the limited scope of prayer sought for in this writ petition and the submissions of the learned counsel on either side, this Court without going into the merits of the case, directs the 1st respondent to consider the representation of the petitioner dated 02.09.2023 and pass appropriate orders on merits and in accordance with law, after giving opportunity of hearing to all interested parties/rival claims if any as expeditiously as possible preferably within a period of three months from the date of receipt of copy of this order.

5. With the above directions, the writ petition is disposed of at the admission stage itself. However, there shall be no order as to costs. 20.10.2023 ksa-2 Index : Yes / No Speaking Order : Yes / No 3/5
