A.No.5367 of 2022 has been filed seeking extension of time to carry out the amendment in plaint pursuant to the order passed by this Court in A.No.2427 of 2020 in C.S.No.764 of 2013 dated 19.11.2020.

2. According to the applicant, the application for amendment to include the legal representatives of the second respondent was allowed on 19.11.2020, with the direction to the applicant to file an amended plaint by 10.11.2022. It was stated by the applicant that on account of the Covid-19 and restricted entry to Courts, the applicant's counsel was under an impression that physical amendment was waived and the Registry would carry out the necessary amendment by itself. Later, when the applicant filed application to amend the legal representatives of deceased second defendant, he came to know that amendment has not been carried by the Registry. Therefore, the applicant constrained to file this application seeking extension of time.

3. The learned counsel for the respondents has no objection for allowing this application.

4. Hence, this application is allowed.
