ORDER

This application has been filed to appoint an Advocate Commissioner to take custody of the vehicle being MARUTI CAT C CIAZ bearing Chassis No.MA3FXEB1S00346764EJ, fitted with Engine No.D13A3321714 and registered as TSO8GE3179 from the respondent.

2. When the matter was taken up for hearing today, the learned counsel for applicant submitted that the trigger notice under Section 21 of the Arbitration and Conciliation Act was issued on 30.07.2025 and an Arbitrator has also been appointed.

3. In the light of the above submission, this Court is not inclined to exercise its jurisdiction under Section 9 and liberty is granted to the applicant to move the Arbitrator under Section 17 of the Act and the same will be dealt with on its own merits and in accordance with law.
