When the matter is taken up for hearing, the learned Government Advocate (crl.side) submitted that the bail was already granted to the petitioner for the offence under Sections 296(b), 118(1) and 351(3) f BNS and thereafter, the Sections were altered to 296(b), 118(1), 351(3) and 109 of BNS.

2. The learned counsel for the petitioner submitted that due to alteration in the first information report, the petitioner could not execute the sureties before the concerned Magistrate. 3.Since this Court had already granted bail to the petitioner and thereafter, the Sections were altered, bail cannot be granted to the petitioner once again.

4. Therefore, this Court is inclined to add Section 109 of BNS in the previous order Crl.O.P.No.22754 of 2024 dated 18.09.2024. This Court has also extended the time to execute the sureties before the trial Court for a period of 15 days from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis 1/2

vkr 5.In view of the above, this Criminal Original Petition is disposed of.

19.10.2024 vkr Note:Registry is directed to carry out necessary amendment in the order copy in Crl.O.P.No.22754 of 2024 dated 18.09.2024 by adding the above said section and issue a fresh order copy.
