ORDER

The allegation in this case is that on 17.03.2008, all the 10 accused formed themselves into an unlawful assembly and attacked and threatened the defacto complainant. The case was taken on file as C.C.No.59 of 2013. Since accused No.10 alone was shown as absconding, the case was split up. The trial against the other accused was concluded, and the case against accused No.10 alone is now pending in C.C.No.145 of 2024.

2. It is seen that the name of accused No.10 was included only because it was mentioned in the initial complaint, but his identity and address remain unverified. It has been assertively submitted that no such person exists at the said address. Further, the trial against accused 1 to 9 ended in acquittal on merits. In such view of the matter, no useful purpose will be served by keeping this case pending.

3. Accordingly, the proceedings in C.C.No.145 of 2024 on the file of the District Munsif Cum Judicial Magistrate No. 1 Court, Wallajahpet stands quashed and this Suo Motu Transfer Case stands disposed of. 21.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
