ORDER

The allegation in this case is that on 29.08.2019, the accused, in an inebriated condition, created a ruckus in the middle of the road and upon being questioned, attacked the defacto complainant with a small knife on his right leg below the knee. A case was registered in Crime No.440 of 2019 under Sections 294(b) and 324 of Indian Penal Code, 1860. The final report was filed on 08.12.2019 and the case is pending. Page No.1 of 3

2. It is stated that despite best efforts, neither the accused nor the defacto complainant could be traced by the police. Considering the nature of this case, even if the accused is traced in the future, it would impinge upon the right to a speedy trial.

3. Accordingly, the proceedings in C.C.No.30 of 2020 on the file of the Judicial Magistrate No. 3, Erode Taluk, Erode stand quashed and this Suo Motu Transfer Case stands disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
