ORDER
This Criminal Original Petition has been filed to direct the respondents to register an FIR in respect of my complaint dated 10.01.2022 to the respondent herein duly investigate the same and prosecute the offenders in accordance with law.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondents.
3. The learned counsel for the petitioner submitted that the petitioner and her sister Karthiga are the daughters of one P.Ramu and K.Shenbaga Rani; the mother of the petitioner was working as a Teacher in the Government School and she is no more; the father of the petitioner by name P.Ramu was a Principal in some other School; now he has been promoted as Block Education Officer, Harur; by making use of the relationship and influence, the father of the petitioner coerced her mother to create her service records in such a way that all the terminal benefits would be entirely taken by the petitioner's father alone.
3.1. The learned counsel for the petitioner also pointed out the differences in the signature of the mother of the petitioner in the Identity Card and the nomination form, where it is found that 100% of the gratuity of the deceased mother should be taken by the father of the petitioner.
4. The grievance of the petitioner is that despite she had given a complaint by alleging these serious facts, no proper action has been taken by the first respondent police.
5. The learned Government Advocate (Crl.Side) submitted that on the complaint given by the petitioner, an enquiry has been initiated and the same was closed as "mistake of fact".
6. However, the learned counsel for the petitioner submitted that notice for closure report has not been served on the petitioner so far.
7. The first respondent police is directed to furnish the notice of closure report forthwith to the petitioner and on receipt of the same, the
petitioner is either at liberty to accept the same or to file a protest petition or initiate appropriate proceedings under Section 156(3) or 200 of Cr.P.C., before the appropriate forum.
8. With the above observations, this Criminal Original Petition is disposed.
