ORDER

The allegation in this case is that on 09.03.2015, the accused rode his two-wheeler bearing Registration No. TN 33 BF 4862 in a rash and negligent manner and dashed against another two-wheeler TVS XL Super bearing Registration No. TN 34 H 7906, causing simple injuries to one witness and grievous injuries to another.

2. The accused, who was a Village Administrative Officer, was Page No.1 of 3

suspended from service and remains untraceable. Despite best efforts, summons could not be served and NBW has been pending since 2019. The case is of the year 2015. Even if the warrant is executed in the future, it would violate the right to a speedy trial.

3. Accordingly, the proceedings in S.T.C.No.2300 of 2019 on the file of the Judicial Magistrate No.1, Erode Taluk, Erode stand quashed and this Suo Motu Transfer Case stands disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
