Respondents Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the 1st respondent to issue the fresh passport to the petitioner by considering the petitioner's Passport Application File No.CB2065488544825 dated 13.08.2025 within the time

frame as fixed by the Court.

ORDER

This writ petition has been filed for issuance of a mandamus to the first and second respondents to deal with the application submitted by the petitioner on 13.08.2025, wherein the petitioner is seeking for the issuance of passport in his name.

2. The learned Government Advocate appearing on behalf of the third respondent submitted that investigation is pending in Crime No.303 of 2021, wherein the petitioner has been made as an accused.

3. Taking into consideration the facts and circumstances of the case and considering the fact that only investigation is pending in Crime No.303

of 2021, the same cannot be taken to be a criminal case pending against the petitioner. Law on this issue is too well settled.

4. In view of the above, there shall be a direction to the first respondent to act upon the application submitted by the petitioner on 13.08.2025 and issue the passport to the petitioner, if the petitioner has satisfied all the other requirements. This process shall be completed within a period of four weeks from the date of receipt of a copy of this order.

5. This writ petition is disposed of with the above direction. No costs. Index : yes/no 28.08.2025 ss To
