ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. The defacto complainant is present before the Court, she submits that the accused is the brother of her husband his whereabouts are not known for the past nine years. She submits that the situation does not exist and she has moved on and the case can be closed. The offences are in the nature of 294(b) Page No.1 of 3

and 506(2) of IPC and Section 4 of TN Prohibition of Harassment of Women Act, 2002.

3. In view thereof, even if the respondent police apprehends the accused and he has got to face the trial, the same would be impinging upon the right to speedy trial of the accused and no useful purpose will be served by keeping this matter pending. Accordingly, the case in CC.No.700407 of 2017 on the file of the Judicial Magistrate Court No.II , Kallakurichi Taluk, Kallakurichi is quashed and this Suo Motu transfer case is disposed of. 25.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
