ORDER

The allegation in this case is that on 12.05.2018, the accused drove a tipper lorry bearing registration No. TN 19 A 8892 in a rash and negligent manner and hit the deceased, causing his death. A case was registered on the same date and the final report was filed on 24.11.2018. The accused has been absconding from the beginning.

2. It is stated that the dependents of the deceased have already been compensated in a claim petition. Despite best efforts for 7 years, summons Page No.1 of 3

and Non-Bailable Warrant could not be executed. Even if the warrant is executed in the future, it would violate the right to a speedy trial of the accused.

2. Accordingly, the proceedings in C.C.No.341 of 2019 on the file of the District Munsif Cum Judicial Magistrate Court, Senthurai Taluk stand quashed and this Suo Motu Transfer Case stands disposed of. 21.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
