The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 8(c), 20(b)(ii)(B) of Narcotic Drugs and Psychotropic substances Act, in Crime No.963 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that, the petitioner was found in illegal possession of 1 kg 200gms of Ganja. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. He would further submit that this is the third anticipatory bail petition filed by the petitioner. Earlier petitions filed by the petitioner were dismissed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that there are totally 4 accused in which the petitioner is arrayed as A4. The petitioner and other accused were in conscious possession of 1 kg 200gms of Ganja. He also submitted that there is no change of circumstances after the previous dismissal orders passed by this Court. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Taking into consideration the facts and circumstances of the case and the bad antecedents of the petitioner and also the earlier petitions filed by the petitioner were dismissed by this Court and that there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed with cost.
