The petitioner herein seeks anticipatory bail in Crime No.45 of 2023 registered by the respondent Police for the offences under Sections 8(c), 20(b)(ii)(B) of NDPS Act.

2. The learned counsel for the petitioner stated that the petitioner is an innocent person and he has been falsely implicated in this case. Thus, he seeks anticipatory bail to the petitioner.

3. It is stated by the learned Government Advocate (Crl.Side) that on 31.07.2023, the respondent had received a information about selling of ganja at Annai Sathya Nagar C-Block. It was stated that they reached the spot and caught one of the accused with possession of 1.200 kgs of ganja. It had been stated that, on confession he had stated that he got the ganja from the present petitioner.

4.The petitioner will have to be necessarily investigated about the source of the purchase of ganja.

5. It is stated that other accused had been granted bail. But that would not influence this Court to grant anticipatory bail to the petitioner herein.

6. In view of the fact that investigation has to be done about the source of ganja, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 03.11.2023 gd 2/3
