PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the respondents to give adequate Police Protection to the petitioner based on the petitioner's representation dated 23.09.2023 in accordance with law take necessary legal action. ORDER
A civil dispute is pending between the petitioner and the private respondent. Since the interim injunction stands in favour of the petitioner, he wants police protection. The interim status quo of the Civil Court dated 01.09.2023 has to be maintained. In the said circumstances, request is made to give Police Protection, alleging that on 18.09.2023, at 11.00 a.m, the private respondents attempted to trespass into the lands of the petitioner.
2. If the Civil Court has seized of the matter regarding the possession and enjoyment, it is appropriate for the other party to report before the said Court about any breach of the interim order. Thereafter, the present petition seeking police protection alleging criminal trespass, as such, if found to be proper, police may take necessary action, otherwise, a blanket protection order for the petitioner to enjoy the property based on the status quo order is improper. Hence, this petition is disposed of and the petitioner is directed to work out the remedy in accordance with law.
