C.M.P.No.20345 of 2022 in A.S.No.544 of 2022 P.T.ASHA, J., The petition has been taken out in C.M.P.No.20345 of 2022 for receiving additional documents, namely, 1. Valuation Report by approved valuer, 2. Lease Agreement dated 23.02.2021, 3. Coastal Regulation Clearance Document, 4. Clearance Certificate of Airport Authority of India.

2. The 3rd document which is the Coastal Regulation Clearance document is incomplete as it is only the 1st page which has been filed into Court. The learned counsel for the appellant assured the Court that the complete document will be filed into Court by 02.11.2023. Though the appellant had sought for the remand of the suit back to the Trial Court for marking of these documents, the learned counsel for the respondent has no objection to the documents being marked and the evidence being taken by this Court. Accordingly, C.M.P.No.20345 of 2022 is ordered as prayed for and the documents are taken on file subject to the complete set of the 3rd document being filed into Court on or before 02.11.2023. It is needlees to state that the document now received shall be subject to proof and relevancy.

3. D.W.1 shall enter the box on 23.11.2023 and 24.11.2023 at 2:15.p.m for his chief and cross examination. It is made clear that taking of evidence is subject to the complete set of the 3rd document being filed. 1/3
