These petitions have been filed seeking to condone the delay of 486 days in filing the petition to set aside the abatement, to set aside the abatement caused due to the death of sole petitioner, and to bring on record the petitioners 2 to 5 as legal heirs of deceased sole petitioner in this Civil Revision Petition.
2. Mr.G.Mohanakrishnan, learned counsel appearing for petitioners submitted that, pending Civil Revision Petition, sole petitioner Vanajatchiammal died on 25.01.2018. Hence, the legal heirs of deceased Vanajatchiammal filed the above petitions to bring them on record as her legal heirs, and also two other petitions to condone the delay in filing the same, and to set aside the abatement.
3. Mr.K.Chander, learned counsel appearing for 4th respondent has raised serious objections in allowing the above petitions.
4. Considering the fact that, the sole petitioner died, and only the legal heirs of deceased petitioner wants to bring them on record, I am inclined to allow all the above petitions.
5. The Registry is directed to carry out necessary amendment in the cause title, and post the matter on 16.12.2019 under the caption "For orders".
