The petitioner who was arrested and remanded to judicial custody on 04.03.2023 for the offences registered under Sections 8(c), 20(b)(ii)(c), 25, 29(1) of NDPS Act, in Crime No.44 of 2023, seeks bail. 2.The case of the prosecution is that the petitioner was found in illegal possession of 21.7 kgs of Ganja.

3.The learned counsel for the petitioner stated that the petitioner has been in judicial custody for nearly about 200 days. 4.It is however stated by the respondent that the petitioner had been in possession of 21.7 kgs ganja and on his confession, A4, A6 and A7 have been arrested and from them, there is no recovery and therefore, they were granted bail. Sofaras the petitioner is concerned, recovery was made.

5.In view of that particular fact and the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner. 6.Hence, this Criminal Original Petition stands dismissed. 06.11.2023 vkr 1/2 https://www.mhc.tn.gov.in/judis
