ORDER
(Order of the Court was made by the Hon'ble Chief Justice) This writ petition filed under Article 226 of the Constitution of India seeks a direction in the nature of writ of mandamus directing respondents 1 to 3 to remove the encroachment made by the 4th respondent in the Government Canal Poramboke land in Survey No.77/3, 78/2 situated at Jimmandiyur Village, Puliyampatti Post,

Learned counsel for the respondents have filed a counteraffidavit stating that the 4th respondent had voluntarily demolished the encroaching compound wall portion, however, the front wall of the house is still in the margin of the encroachment and removing this portion would result in the collapse of the entire building. It is further
stated in the counter that as of now, sufficient passage is available for the free flow of water through the canal and underground pipelines have been installed to carry water to the nearby agricultural fields without causing any obstruction.
3. Since the 4th respondent had voluntarily removed the encroached compound wall and as such, there is no obstruction in the free flow of water, we dispose of this writ petition with the observation that the 4th respondent shall not raise any further construction or make any obstruction on the Government land in future. There shall be no order as to costs.
