The Criminal Original Petition has been filed seeking to quash the First Information Report pending on the file of the first respondent Police in Crime No.80 of 2024, registered for the offence under Sections 406, 420 and 120 B IPC.

Heard both sides and perused the materials available on record.

The crux of the allegation is that the accused persons, including one who employed in the Customs Department, had promised to deliver the goods seized by the Customs office to the de facto complainant. On believing them, the de facto complainant is stated to have paid the amount to the accused. However, no goods were delivered to him and he was cheated to the tune of Rs.2,24,00,000/-.

A perusal of the allegations in the First Information Report would indicate that the amount was paid only for the purpose of purchasing seized items from the Customs Department. Therefore, the allegations themselves indicate that the de facto complainant has also attempted to perpetrate the offence.

In view of the above, this Court is of the opinion that a thorough and proper investigation is required in this case. Accordingly, the first respondent Police is directed to conduct the investigation in the manner known to law and take appropriate action against all the persons involved. It 2/4

is made clear that if during the course of investigation, it is found that the de facto complainant has also committed any offence, the Investigating Officer shall proceed against him in accordance with law. 6.
