ORDER
The defendants 1 and 4 have filed this revision to strike off the plaint in OS No.6189 of 2022 pending on the file of the VI Assistant City Civil Court, Chennai, stating that the prayer sought in the plaint has become infructuous. Pending suit, the election was conducted and new office bearers were elected. Therefore, the prayer sought in the plaint is not maintainable and prays to strike off the plaint.
2. The learned counsel for the respondents raised objections stating that the alleged election which is to be conducted after the suit, as such, is only a paper work and it was not happened as per the manner known to law and to that effect, they already lodged a complaint against the police also as on date. According to the revision petitioner, the election was conducted and new officer bearer are functioning. But the respondents stated that no such election was conducted. This is a matter for trial and at this stage, this Court is not inclined to strike off the plaint. However, direction is given to the trial court to conduct
the trial and dispose of the case within a period of six months from the date of receipt of a copy of this order. Both the parties are directed to adduce evidence and cooperate for trial.
