ORDER

The allegation in this case is that on 05.11.2015, the defacto complainant parked his autorickshaw bearing Registration No. TN-23-AH3298 in front of his house and it went missing. A case was registered in Crime No.447 of 2015 under Section 379 of Indina Penal Code, 1860. The accused was later apprehended and the auto was recovered and handed back to the complainant.

2. Thereafter, the accused absconded. Non-Bailable Warrant has been pending since 2017. Despite best efforts, the police have been unable to trace him. Considering the case is pending for 10 years, even if the warrant is executed, it would impinge upon the right to speedy trial.

3. Accordingly, the proceedings in C.C.No.43 of 2017 on the file of the Judicial Magistrate No. 2 Court, Wallajahpet Taluk, Ranipet stand quashed and this Suo Motu Transfer Case stands disposed of. 21.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
