Heard the learned Additional Government Pleader appearing for the petitioner.
2. None appeared on behalf of the first respondent.
3. Despite name is printed in the cause list, no representation on behalf of the second respondent.
4. Though we are not satisfied with the reasons assigned in the accompanying affidavit to condone the inordinate delay of 464 days in filing the writ appeal, considering the facts of the case, we inclined to allow the petition on payment of costs to compensate the hardship suffered by the first respondent/ writ petitioner, inview of the said delay.
5. Accordingly, this petition is allowed, on condition that the petitioner shall pay a sum of Rs.2,000/- (Rupees two thousand only) to the first respondent/writ petition.
6. The Registry is directed to number the appeal, upon receipt of payment of costs and also, if the writ appeal is otherwise found to be in order.
