This Civil Miscellaneous Petition has been filed seeking to appoint advocate commissioner to identify the boundaries of the suit schedule property by surveying metes and bounds of appellants and respondent with the assistance of revenue department officials as per title deeds and file a report.

2. Today, when the matter taken up for hearing, both learned counsel for appellants and learned counsel for the respondent appeared.

3. It is brought to the notice of this court that after filing of the suit, according to the plaintiff, the defendants have trespassed and constructed a house in the suit property. Hence, the appellants/defendants have filed this petition to appoint an advocate commissioner.

4. Considering facts and the circumstances of the case, Mr.V.Anandhamoorthy, Advocate (Mobile No.75400 99555), having office at No.3,229/6, 1st floor, Mercantile Plaza (Opp. to High Court), NSC Bose Road, Chennai-600 001 is appointed as Advocate Commissioner and he is

directed to visit the property and to identify the boundaries of the suit schedule property by surveying the metes and bounds of the appellants and respondent in S.A.No.608 of 2024 with the assistance of revenue department officials as per title deeds of documents vide Nos.3199/1924, 3062/1934, 1188/1939, 2140/1947, 892/1952, 1278/1959 and 3153/2004 and submit a report before this court on 03.12.2024. The appellants are directed to bear the expenses to be arrived for the same. The Commissioner fee of Rs.40,000/- is to be paid to the Commissioner directly by appellants excluding travel expenses.

5. Registry is directed to print the name of Mr.V.Anandhamoorthy, learned Advocate Commissioner in the cause list and post the matter on 03.12.2024 for filing the report.
