The petitioner seeks modification of the order in Crl.O.P.No.18728 of 2023 dated 24.08.2023 particularly of the condition stipulated in paragraph No.8 that the petitioner shall produce his passport.

2. The learned counsel for the petitioner states that the petitioner is employed in a shipping company and therefore, he will have to sail in the ship and be out of the country, therefore, he cannot produce the passport as directed. The learned counsel had produced the details of the company which is directly responsible for the petitioner herein namely Buena Vista Shipping LLP, B 4069, Oberoi Gardens, Next to Boomerang, Chandivali, Andheri (East), Mumbai 400 072, Tel.91 22 40226757/2857 5005, Mob.+91 9819075233, E-mail:

3. The petitioner may produce two sureties but the respondent may inform the aforementioned company that the petitioner is an accused in Crime No.4 of 2023 registered under Sections 294(b), 417, 354(c) and

506(i) of IPC and Section 4 of TNPHW Act, 2002 and also inform them that it is their responsibility to ensure that the petitioner subjugates himself to the jurisdiction of this Court as and when directed. The copy of the letter addressed to aforementioned company by respondent and their acknowledgement may be filed before the Magistrate Court who may keep the particular acknowledgement in the records. Quite apart from a letter by registered post, the respondent may also send an e-mail to the said company about this fact.

4. In view of this particular order, the direction to deposit the passport is modified.

5. The time for producing sureties is extended till the respondent gets acknowledgement from the aforementioned company about the information given to them that the petitioner is an accused in the above mentioned Crime No, after that acknowledgement is filed, within a period of two weeks thereafter, sureties must be executed. 15.11.2023 nr
