ORDER

This Criminal Original Petition has been filed to call for the records in CC No.42/2024, pending on the file of the Judicial Magistrate, Additional Mahila Court, Udhagamandalam and to quash the same.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent-Police and perused the materials available on record.

3. The petitioner is arrayed as A2 for the alleged offences under Sections 294(b), 324 and 506(ii) of the IPC read with Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002. The charges as against the accused persons is that A1 and A2 abused the de-facto complainant and A1 assaulted the defacto complainant and molested his wife. 2/5

4. On a perusal of the records, it is seen that there is no serious allegations are made as against the petitioner, except the contents that the petitioner abused the defacto complainant. Further, there is no specific words whatsoever stated in the entire statements of the witnesses as against the petitioner herein. In such view of the matter, prosecution as against the petitioner will not serve any purpose. Hence, this Court is inclined to quash the impugned proceedings in C.C.No.42 of 2024 with regard to the petitioner herein. Accordingly proceedings in CC No.42/2024, pending on the file of the Judicial Magistrate, Additional Mahila Court, Udhagamandalam as against this petitioner stands quashed.

5. In view of the above, this Criminal Original Petition is allowed. Consequently, connected miscellaneous petition is closed. 23-09-2025 mfa Index:Yes/No Speaking/Non-speaking order Internet:Yes 3/5
