Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents 1 to 5 to remove the entire illegal and unauthorized construction put by the respondents 6 to 9 in Old S.No.58/1, New S.No.98/13 in Ellaiamman Kovil Street, Neelangarai Village, Sholinganallur Taluk, Chennai - 600 115 and further direct the respondents 1 to 5 to retrieve the public street in S.No.98/12, Neelangarai Village, Sholinganallur Taluk, Chennai District by removing the encroachments made by the respondents 6 to 9 by considering the petitioner's representation dated 07.09.2023.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.S.A.Sayed Shuhaibb, learned counsel for the petitioner, Mr.R.Thamarai Selvan, learned Standing Counsel for respondent 1, Mr.D.B.R.Prabhu, learned counsel for respondent 2 and Mrs.R.Anitha, learned Special Government Pleader for respondents 4 and 5. 2.

The petitioner alleges encroachment by the private respondents. In fact, the petitioner has given a representation on 07.09.2023 and within one month, the petitioner has filed the present petition seeking a direction against the official respondents to consider the representation.

3. We cannot encourage such petitions. If steps are not taken within a reasonable period, then the aggrieved party can agitate.

4. In the light of that, at present, we are not inclined to pass any order in the writ petition. If a decision is not taken on the

representation of the petitioner within a reasonable period, then the petitioner may move a fresh petition.

5. In view of that, the writ petition stands disposed of. There will be no order as to costs.
