Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order of the First Respondent in Na.Ka. No. 1/4

1298 Thi(Ma) Va/2021 dated 28.06.2023 and consequential impugned proceedings of the Second Respondent dated 21.07.2023 and quash the same as illegal and consequently direct the First Respondent to grant permission for the Petitioner to set up a tea stall which was already under the process. O R D E R

Heard Mr. A.Nilesh Ram, Learned Counsel for the Petitioner and Mr. S.J.Mohammed Sathik, Learned Government Advocate, who takes notice for the Respondents and perused the materials placed on record, apart from the pleadings of the parties.

The Petitioner seeks permission to set up a tea stall in the premises of the Government Multi-Speciality Hospital, Omandurar Estate, Chennai - 600002 in this Writ Petition.

In response, Learned Additional Government Pleader appearing for the Respondents, on instructions, informs that as sufficient stalls are already functioning in the said premises, it would not be possible to accommodate the Petitioner in that place.

In such circumstances, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition reserving the right of the Petitioner, if he has any further grievances, to work out his remedies before the proper forum in the manner recognized by law. In fine, the Writ Petition is dismissed as withdrawn with the aforesaid clarifications. No costs.
