Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents 1 to 4 to initiate immediate action against the demolition and construction of superstructures being done by the respondents 5 to 7 at Door No.32, New Door No.4, bearing Plot No.34, Bharatwajar Street, East Tambaram, Chennai 600 059, comprised in Survey No.333/A1 at No.173, Selaiyur Village, Tambaram Taluk, Kancheepuram District, land measuring an extent of 4800 sq.ft [11 cents] without due permission or approval from the respondents 1 and 2.

ORDER

[Order of the Court was made by M.SATHYANARAYANAN, J.,] (1)After some arguments, the learned counsel for the petitioner, on instructions, seeks the permission of this Court to withdraw this writ petition with liberty to work out his remedy against the private respondents who are said to have indulged in mischief in the form of illegal / unauthorized demolition and construction of the superstructure, in accordance with law, if it is available to him and also made an endorsement in the petition to that effect.

(2)In view of the submission and endorsement made by the learned counsel for the petitioner, this writ petition stands dismissed as withdrawn and the liberty sought for by the petitioner, is granted. No costs. Consequently, the connected miscellaneous petition is closed.
