ORDER

The allegation in this case is that, on 03.11.2012, the accused was riding his Bajaj Discover motorcycle bearing Registration No.TN 31 AY 1399 in a rash and negligent manner and hit against the two Wheeler, in which the deceased was travelling, caused injuries and died. 2.

When the matter came up for hearing, it is brought to the notice of Page No.1 of 3

the Court that, the dependents have already filed claim petition and the Motor Accident Claims Tribunal has already awarded the compensation. It can be seen that, the accused was not in the address that is originally mentioned and he remains completely untraceable for the past 13 years. Even if summon is served or warrant is executed on any future date, the same would impinge upon the right to speedy trial of the accused. 3.

Considering the nature of accident and allegations in this case, no useful purpose will be served in keeping the matter pending. 4.

Accordingly, the proceedings in CC.No.20 of 2020 on the file of the learned Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur is quashed and this Suo motu Transfer Case is allowed. 21.08.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
