ORDER

The allegation in this case is that, on 18.05.2020, the accused drove the Baleno Car, bearing registration no. KL 45 Q 6049 in a rash and negligent manner and hit against the Hero Honda Splendor vehicle bearing registration no. TN 56 M 3979 and caused injuries to the deceased, who died in the accident.

2. When the matter came up for hearing, it stated that under the victim Page No.1 of 3

compensation scheme, Rs.1,00,000/- was paid to the dependents and they have also filed claim petitions and subsequently, another sum of Rs.9,00,000/- was awarded. The accused had given the address as Chiramal House, Marathakkara PO, Thrissur, Kerala State. It is stated that even after verification, no such person existed in the said address. In spite of the best efforts of the police for the past 5 years, the accused is elusive and no summons could be served and the case is pending for the past 5 years at the await summons stage.

In view thereof, even if summons were served in any future date, the same will impinge upon the right to speedy trial of the accused and as such, no useful purpose will be served in keeping the matter pending. Accordingly, the proceedings in CC.No.34 of 2022 on the file of the learned Judicial Magistrate No.3, Erode Taluk, Erode is quashed and this Suo Motu Transfer Case is allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
