ORDER

The allegation in this case is that, on 22.09.2019, when the defacto complainant's car was parked, the accused had broke open the glass and took away a sum of Rs.2000/- which was kept inside the car.

2. It is seen that the said sum of Rs.2,000/- was recovered and handed over to the defacto complainant. The accused remains elusive from the year 2019 and is normally not found in the usual address. As on date, the service is pending. Considering the nature of allegations and even if summon is served Page No.1 of 3

on any future date, the same would impinge upon the right to speedy trial of the accused and as such, no useful purpose will be served by keeping the matters pending.

3. Accordingly, the proceedings in CC.No.126 of 2021 on the file of the learned Judicial Magistrate No.2, Gobichettipalayam Taluk, Erode is quashed and this Suo motu Transfer Case is allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
