ORDER

The allegation in this case is that, on 17.09.2015, when the defacto complainant parked the cycle in front of the bunk shop of the accused, a wordy quarrel arose and the accused is said to have attacked the defacto complainant by a Reaper. The nature of injuries that is complaint of, does not demonstrate any grievous injuries. Secondly, it is further seen that the accused became indebted and has run away from the place and is now remains untraceable and the present whereabouts is also not known. There is no any likelihood of further confrontation between the defacto complainant and the accused. Both Page No.1 of 3

the accused are father and son and the family itself has escaped from the place. 2.

The case is now pending from the year 2015. Even, if summon is served on any future date, the same will impinge upon the right of speedy trial of the accused and as such, no useful purpose is served in keeping the matter pending.

Accordingly, the proceedings in CC.No.100141 of 2018 on the file of the learned Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur is quashed and this Suo Motu Transfer Case is allowed. 21.08.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. Page No.2 of 3
