O R D E R
Mr.U.M.Ravichandran, learned Special Government Pleader accepts notice for R1 and is armed with instructions to enable final disposal of this Writ Petition, even at the stage of admission. He states that the appropriate authority to look into the grievance of the petitioner is not the Chief Educational Officer but the District Educational Officer, (Private Schools), Tiruppur. Hence the array of R1 stands substituted to District Educational Officer, (Private Schools), Tiruppur instead of Chief Education Officer, Tiruppur.
2. No notice is thought necessary to R2 private respondent, in light of order that is proposed to be passed in this Writ Petition taking note of the interests of R2 as well.
3. The prayer of the petitioner is that R2 school, i.e., Lourde Matha Convent Matric Hr. Sec. School in Tiruppur District is collecting fees over and above what it is entitled to and is not issuing receipt as well. Some other allegations are also made in the affidavit as against the second respondent.
4. The petitioner has addressed a representation to the Chief Educational Officer setting out some grievances as set out in the writ affidavit. Since no acknowledgement is placed evidencing receipt of representation by R1, the petitioner is permitted to reiterate his request/grievance by way of fresh 2/4
representation to the District Educational Officer (Private Schools), Tiruppur within a period of four (4) weeks from date of receipt of a copy of this order.
5. The District Educational Officer, Tiruppur/R1, upon receipt of such representation, if filed within the aforesaid stipulated time, shall issue notice to the petitioner as well as to R2, hear them, consider evidences, if any filed in support of their submissions and pass orders on merits and in accordance with law, within a period of four (4) weeks from date of personal hearing.
