ORDER

This Criminal Original Petition has been filed to direct the respondent not to harass the petitioner and his family members.

2. The case of the petitioner is that he is facing trial in C.C.No.40 of 2025 on the file of the Judicial Magistrate No.I Court, Cuddalore. The grievance of the petitioner is that though the petitioner is contesting the case without any absence, the respondent police are coming to the petitioner's house everyday and harassing the petitioner and his family members by insisting the petitioner to come to the police station. Hence, the present petition.

3. The learned Government Advocate [Criminal Side] appearing for the respondent on instructions submitted that the petitioner is a history sheeter and notice under section 110 of Cr.P.C. has been served to the petitioner.

4. Such being the position, it is for the investigating agency to issue appropriate notice under section 35[3] of BNSS to the petitioner for enquiry and on such notice, the petitioner shall appear for enquiry and co-operate with the investigation.

5. With the above direction, this Criminal Original Petition is disposed of.
