This original petition has been filed taking advantage of Sections 300 and 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the debts in the name of Mr.R.Thangapandian, who died on 02.04.2021. The 1st petitioner is the widow of the deceased. The 2nd, 3rd and 4th petitioners are the daughters. They filed an application for succession certificate in respect of 'A' schedule property which is shared in the Tamil Nadu Mercantile Bank Limited. The details of the securities had been given in the schedule to the petition. Paper Publication has been effected. 2.After following due procedure, the petitioners were invited to tender evidence. Accordingly, the 2nd petitioner was examined as PW-1 and Exs.P1 to P7 had been marked and the details of share are given below:- S.

P.W.1 in his evidence has stated that the first petitioner's husband and the 2nd to 4th petitioners father R.Thangapandian had developed some health issues and he died at the age of 74 years on 02.04.2021 at Door No.106 D, Vanniyar Street, Padi, Chennai, 600 050, intestate leaving behind petitioners herein to inherit his estates.

The Tahsildar, Ambattur Taluk issued a legal heirship certificate bearing Certificate No.TN-720210715513, certifying that the deceased died leaving behind his wife namely T.Vijayalakshmi (the 1st petitioner herein) and children Mrs.T.Ponmalar, Mrs.R.Kaveri and Mrs.A.Seethalakshmi the petitioners 2 to 4 herein and mother Ponnammal died in the year 1950. Hence, the petitioners alone are the legal heirs of the deceased R.Thangapandian.

6.In view of both oral and documentary evidences adduced before this

Court, I find no impediment for grant of succession certificate.

7. Accordingly, this Original Petition is allowed. The Succession Certificate may be issued in favour of the 1st petitioner in accordance with the rules.
