ORDER
This petition has been filed to set aside the order dated 31.07.2025 passed in Crl.M.P.No.730 of 2025 by the learned Judicial Magistrate No.II, Tiruvannamalai, further direct the respondent to return the vehicle HONDA ACTIVA6G STD bearing Registration No.TN-25-BR-9784.
2. The learned counsel appearing for the petitioner submitted that the petitioner came to know that his two wheeler was utilized for transporting contraband. After the bike was seized it was informed by the respondent police. If the bike is kept in open air and sunlight, it would be valueless.
3. Per contra, the learned Government Advocate (Criminal.Side) appearing for the respondent raised serious objection for allowing this petition. He further submitted that 300 grams of ganja were seized in this case. The Two-Wheeler bearing No.TN-25-BR-9784 (HONDA ACTIVA6G STD) was utilized for selling contraband and hence, the above two-wheeler was seized along with other materials from the accused persons. 2/4
4.Heard learned counsel appearing for the petitioner and learned Government Advocate (Criminal Side) appearing for the respondent and perused the materials available on record.
5.Considering facts and circumstances of the case and the submission made by the learned counsel on either side, this Court is of the view that the petitioner may approach the Drug Disposal Committee for return of vehicle.
6. It is a settled proposition that if the vehicle is involved in NDPS Act, they have to approach the Drug Disposal Committee. Therefore, the Authorities take into consideration of the above facts and disburse the vehicle if any application is filed on merits.
7.With the above observations, this Criminal Revision Case is disposed of.
