Learned counsel for the vacate stay petitioner submits that this Court granted interim stay of operation of impugned order on 22.06.2024, however, pursuant to the direction issued by the first respondent in paragraph No.9 of the impugned order, based on complaint by the 7th respondent the FIR has been registered against the petitioner on 22.06.2024 in Crime No.39 of 2024 on the file of the Central Crime Branch, Coimbatore and therefore the stay obtained by the petitioner has become infructuous, as far as the direction for criminal prosecution issued in paragraph No.9 of the impugned order is concerned.

2. On verification of records it is found that interim stay was granted by this court only on 24.06.2024. In view of the fact that the FIR has been registered even prior to grant of stay, subsequent stay order granted by this Court will not affect the investigation based on FIR. Therefore, the order passed by this Court dated 07.08.2024 confining the stay order to paragraph No.9 has become infructuous. Accordingly, the stay petition and vacate stay petitions are disposed of.

3. List W.P.No.16314 of 2024 'for final hearing' on 13.11.2024.
