Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of Writ of Mandamus, directing the 2nd respondent to consider the representation of the petitioner dated 22.10.2019 and to issue hall ticket for appearing in the practical and theory papers of the third year in the course of Diploma in Civil Engineering in the 3rd respondent college.

This writ petition is filed by the petitioner, who has discontinued her Diploma in Civil Engineering course in the year 2015 and thereafter after gap of 4 years rejoined the course in the year 2019. When she applied for examination, hall ticket was not issued. Hence, before this Court seeking Mandamus to issue hall ticket.

2. The Director of Technical Education has placed the facts on record. According to the report, the petitioner joined Diploma in Civil Engineering in MIT Polytechnic College in June 2014. She only completed 3rd and 4th semester and discontinued her studies in March 2015. After break of 4 years, without proper verification she was re-admitted in the 5th semester. Thereafter, a proposal was sent to the Director of Technical Education of the institute. On scrutiny of the eligibility of the petitioner, the proposal sent by the institute found to be contrary to the existing Rules in force. Hence, the hall ticket of the candidate is withheld.

Having justified the reason for withholding the hall ticket, the Director of Technical Education has stated that though the re-admission of the petitioner is contrary to the existing Rules, since she has been re-admitted and undergone 5th semester course, taking into consideration of the welfare of the candidate, the hall ticket has been issued.
4. Recording the said fact, this writ petition is disposed of with a direction to the petitioner herein to collect the hall ticket from the Director of Technical Education. Consequently, the connected miscellaneous petition is also closed. No costs.
