ORDER

The allegation in this case is that there was a dispute regarding the sale of immovable property between the accused and the defacto complainant. On 31.05.2020, it is alleged that all three accused abused the complainant in filthy language, assaulted him with a stick, compelled him to sign on three blank stamp papers and threatened him.

2. When the matter came up for hearing, the second accused (A2) alone was present. It is reported that first and third accused have died. Second accused has been attending Court since 2020. The complainant is not residing Page No.1 of 3

in the same place, has sold the property and there is no subsisting dispute between the parties. There are no antecedents against A2.

3. Considering the nature of the case, the absence of any ongoing conflict and the fact that second accused alone has been facing the proceedings since 2020, further continuation of the case would impinge upon his right to a speedy trial. No useful purpose will be served by keeping the matter pending.

3. Accordingly, the C.C.No.24 of 2022 on the file of the Judicial Magistrate Court No. II, Gobichettipalayam Taluk, Erode shall stands quashed and this Suo Motu Transfer Case stands allowed. 25.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
