ORDER

The allegations in this case is that, on 23.08.2016, the accused abused the complainant in a filthy language and caused simple injuries to him by using the knife and threatened him.

2. I perused the accident register. The first wound is said to be 1*1*0.5 cm and certified to be simple in nature. The second wound is a lacerated injury of 6 * 3 * 2 cm and it is also certified to be of simple in nature. The accused and the defacto complainant are not residing in the same place. fact, the addreas in the Final report reads that the accused Murugan S/o. Poomalai residing in Arunthathiyar Street, Chinnasalem Taluk. Therefore, the correct address itself is not given. The accused could not be traced and for the past 9 years, the matter is at the summon stage.

3. Considering the nature of allegations and since the matter is pending for the past 9 years and even if summon is served on any future date, the same will impinge upon the right to speedy trial of the accused and as such, no useful purpose will be served in keeping the matter pending. 4.

Accordingly, the proceedings in CC.No.700403 of 2017 on the file of the learned Judicial Magistrate Court No.II, Kallakurichi Taluk, Kallakurichi is quashed and this suo motu transfer case is allowed. 21.08.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
