ORDER

The allegation in this case is that, on 05.07.2012, under the leadership of the Accused No.1, 47 accused persons unlawfully assembled near the bus stop and all of them belongs to a particular political party. 2.

In this case, summons was not served to the Accused No.7 and warrant was issued and thereafter, the case was split up. The case against other persons was conducted on merits and they were all acquitted. Whether such a person as Accused No.7 is existence at all, is also in doubt. It can be seen that Page No.1 of 3

allegations were made against 47 persons and the case is political protest in nature. Even if summon is served in any future date, considering the major allegations, it would violate the right to speedy trial of the accused. Further, already the case is also tried on merits in respect of the other accused and the other accused were acquitted. As such, no useful purpose will be served by keeping the case pending.

Accordingly, the proceedings in C.C.No.81 of 2022 on the file of the learned Judicia Magistrate Court No.II, Jayamkondam Taluk, Ariyalur is quashed and this Suo Motu Transfer Case is allowed. 21.08.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. Page No.2 of 3
