ORDER
The allegation in this case is that, on 21.07.2021, the accused drove the Mahindra Supra van bearing registration no.PY05E6026 in a rash and negligent manner and dashed against the two Wheeler driven by the deceased and caused injuries. On account of which, the rider of the two wheeler died. 2.
In this case, the case was registered on 21.07.2021 in Cr.No. 269 of 2021 and thereafter, final report was filed on 24.08.2021. It is stated that subsequent to this accident, the accused suffered another gruesome accident Page No.1 of 3
and was admitted into hospital. After discharge, he is not residing in the same address that is given as No.10, Sangothiyamman Koil Street, Orleanpet, Nellithoppu, Puducherry. The accused does not have parents or anybody else. For the past 4 years he is unheard of.

In view thereof, considering the nature of the allegations, particularly the manner of accident that is alleged in the instant case, I am of the view that, even if summon is served on any future date, the same will impinge upon the right to speedy trial of the accused and no useful purpose will be served in keeping the matter pending. 4.
Accordingly, the proceedings in C.C.No.22 of 2022 on the file of the learned Chief Judicial Magistrate, Villupuram Taluk, Villupuram is quashed and this Suo Motu Transfer Case is allowed. 21.08.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
