ORDER

The allegations in this case is that, the accused drove the vehicle i.e., Pulsor Motor bike bearing registration no. TN 42 AZ 4165 in a rash and negligent manner and dashed against the another two Wheeler bearing registration no. TN 56 L 5851, in which the witness suffered grievous injuries. 2.

A case was registered on 17.08.2019 in Cr.No.557 of 2019 for the alleged offences punishable under Section 279 and 337 of the Indian Penal Code. Subsequently, charge sheet is also filed and pending. The accused is regularly attending Court and facing the proceedings for the past 6 years. Page No.1 of 3

However, the injured witnesses have changed the address and in spite of repeated summons, they have not come forward for adducing evidence before the Court.

In view thereof, since the accused have undergone the ordeal for the past 6 years, continuing the proceedings would further impinge upon the right to speedy trial of the accused. Therefore, I am of the view that, no useful purpose will be served in keeping the matter pending. 4.

Accordingly, the proceedings in STC.No.2140 of 2020 on the file of the learned Judicial Magistrate No.1, Erode Taluk, Erode is quashed and this Suo Motu Transfer Case is allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
