ORDER
This case relates to theft of SAMSUNG mobile phone. 2.
The allegation in this case is that, on 24.02.2015, when the defacto complainant was travelling the intercity, he has put his mobile phone for charging and when he went for bathroom and came back, the mobile phone was missing. Subsequently, the case was solved and the phone was also recovered from the accused and handed over to the defacto complainant. After filing of the final report, the accused is elusive and NBW is now pending. Page No.1 of 3

Considering the fact that, the case is of the year 2015, even if in near future, the NBW is executed and the accused is brought to face the trial, the allegations are such that, it would impinge upon the right to speedy trial of the accused. Therefore, I am of the view that, no useful purpose will be served in keeping the matter pending.

Accordingly, the proceedings in C.C.No.1800068 of 2015 on the file of the learned Judicial Magistrate III, Salem Taluk, Salem is quashed and this Suo Motu Transfer Case is allowed.
21.08.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
