The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Secti ons 420, 294(b) and 506(2) of IPC in Crime No. 240 of 2022, seeks anticipatory bail.

2. The case of the prosecution as per de-facto complainant Seloniya is that the petitioner along with other accused had induced the de-facto complainant stating that they have advanced to several lands and promising that they will be getting huge profits and received a sum of Rs.1,50,00,000/- from the de-facto complainant, thereby, they have cheated the de-facto complainant. When the de-facto complainant asked for return of the said money, the accused had threatened and abused her in a filthy language. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. The learned Additional Public Prosecutor would submit that, the petitioner is a habitual offender and there are three previous cases of similar in nature, pending as against him. He would also submit that the petitioner had induced the de-facto complainant and received a huge sum of Rs.1,50,00,000/- on the false assurance of purchasing lands and giving profits to her, had cheated her. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and also taking into consideration of the fact that huge money has been involved in this case and the petitioner has previous cases and that there is no proof for settlement between the parties, this Court is not inclined to grant anticipatory bail to the petitioner.
