This Application has been filed to order payment out of a sum of Rs.2,79,383/- standing to the credit of Application No.8291 of 2019 as Court deposit, by issue of Cheque in favour of the applicant.

2. The learned counsel for the applicant submitted that as per the order dated 04.06.2020 passed by this Court in A.No.8291 of 2019, Garnishees/respondents 3 & 4 have deposited a sum of Rs.2,79,383/- to the credit of above Application No.8291 of 2019 and the same is lying as Court deposit, which is clearly evident from the Certificate of Funds dated 11.04.2022 issued by the Registry.

3. Despite the service of notice and the names are being printed in the cause list, none appeared on behalf of the respondents 1 & 2.

4. In view of the above submissions made by the learned counsel for applicant, this Court is inclined to allow this application. Accordingly, this Application is ordered as prayed for.
